Panaji: A North Goa court has dismissed a traffic police inspector’s application seeking to file a case against a traffic offender more than four years after the latter was caught riding without a helmet and didn’t pay the fine. On December 31, 2017, the rider was photographed riding without a helmet at Bicholim’s Shantadurga junction. A notice under Section 133 of the MV Act was issued to the owner of the vehicle through the local police station with directions to pay the fine within 15 days, but the owner failed to do so. The court noted that the inordinate delay of 1,182 days comes to the benefit of the accused and added that in motor vehicle cases, there is a limitation of six months. “It was understandable if there was such an inordinate delay in the case of some serious offence, whereby a thorough investigation was required. But even in serious offences, the investigation is not at all delayed for such a long period,” stated Kalpana Gavas, judicial magistrate first class, ‘A’ court, Bicholim. The PI had submitted that under the Traffic Sentinel scheme, a large number of traffic violations were reported within a short span of time by way of photos and videos. The process of verifying violations, issuing notices, serving the notices manually and thereafter, sorting out the same, took time, he had said.
