Phogat death: Mapusa court grants bail to 2 held in case

Panaji: A Mapusa court on Monday granted conditional bail to two persons who were arrested in a narcotics case connected to the Sonali Phogat case — room boy Dattaprasad Gaonkar and alleged drug peddler Rama Mandrekar. Earlier, the court had granted conditional bail to Edwin Nunes, who ran and managed Curlie’s, the shack at the centre of the Phogat murder case.Anjuna PI Prashal Dessai said that the bail was granted by the additional sessions court, Mapusa.In the aftermath of Phogat’s death, Anjuna police had registered a separate case against four persons. Three of these were arrested, but Anjuna police are yet to arrest Sudhir Sangvan and Sukhwinder Singh — who were arrested in the murder case — in the narcotics case.While Nunes was arrested after meth was found in a Curlie’s toilet, Gaonkar allegedly supplied the drugs to the two main accused, while Mandrekar supplied the drugs to Gaonkar. Anjuna police approached the high court of Bombay at Goa challenging the sessions court order granting judicial custody to the three accused arrested in the narcotics case. The Anjuna PI said that the case is pending in the high court.Phogat arrived in Goa on August 22 with Sangwan and Singh. They allegedly purchased a narcotic substance at the hotel and consumed them before they went to Curlie’s to party.At Curlie’s, Phogat started feeling uneasy, and she later returned to the hotel along with the accused. Initially she was reluctant to go to the hospital, but as her health started deteriorating, she was shifted to the hospital where she was declared brought dead.The CBI on Sunday recreated the scene of the crime at Curlie’s, where Phogat was allegedly drugged, and at the Leoney Grand Resort, in Vagator, where the TikTok star had stayed with her aides after arriving in Goa.The CBI constituted two teams and placed one at the resort and one at Curlie’s to recreate the scene of crime. The investigating agency took a video and photos of the crime scene. The team included forensic experts.

PANAJI: The North Goa planning and development authority (NGPDA) has granted its approval to Mapusa police to prosecute Calangute MLA and former leader of opposition Michael Lobo, and his wife, Siolim MLA Delilah Lobo, in the alleged land filling case at Parra. The NGPDA falls under TCP minister Vishwajit Rane. The Lobo couple were among the eight former Congress MLAs who defected to BJP on Wednesday. A senior government official said that the permission to go ahead with the prosecution was given before the Lobos joined BJP. Michael said on Saturday that the case was political as he was in the “other party”. “There was no land filling. It is agricultural land, and if they want, I will remove that mud. It is an access for other farmers to take agricultural equipment to other fields.” FIR was filed against Lobo, wife for illegal land filling at ParraMapusa police had written to the TCP department seeking permission to prosecute the Lobos. The department then forwarded the request to the NGPDA, which granted its consent. Mapusa police inspector Paresh Naik confirmed that they have received the letter from NGPDA with regards to prosecution. In May 2022, Mapusa police had registered an FIR against the Lobo couple for illegal filling of land at Parra. The FIR had been registered based on a complaint filed by NGPDA. The Lobos have been booked under Section 17B of the Goa Town and Country Planning Act, 1974, under which the offence is punishable with imprisonment of one year and fine of Rs 1 lakh or both. The FIR had stated that the illegality was carried out at Parra prior to November 11, 2020, when Michael was a minister in the BJP government. He held the waste management and science and technology portfolios from July 2019 till he resigned and switched to Congress ahead of the 2022 polls. Any land area which is 50cm or lower from the adjoining ground area is classified as low-lying. The NGPDA had told the police that it had received a complaint from Rama Matondkar that the land had been filled up with mud up to four meters. The NGPDA had said that an inspection confirmed the illegality.

Panaji: Upon directions of the State Information Commission (SIC), the chief secretary has sought a written explanation from the former chief officer of Mapusa Municipal Council (MMC) Clen Madeira for not disposing first appeals filed before him under Section 19 (1) of the Right to Information Act, 2005. The SIC, in the same matter, had directed the director of municipal administration to seek clarification from public information officers (PIO) of MMC for failing to provide the information within 30 days, and instruct the PIOs to act in accordance with the provisions of the RTI Act. Accordingly, director of urban development Gurudas Pilarnekar, in a memorandum issued on September 5, directed the PIOs and assistant PIOs of MMC to ensure that RTI matters are dealt with in a time-bound manner. Any lapses on the part of the officers will be considered as dereliction of duties which will be specifically noted, and in such cases, action as deemed fit under the rules will be initiated, he stated. Under secretary to chief secretary Pranab G Bhat, in a letter issued to Madeira, the then first appellate authority, MMC, has stated that the SIO observed that he did not dispose first appeals filed before him by Jawaharlal T Shetye, a resident of Khorlim, Mapusa within the mandatory period of 45 days in conformity with Section 19(6) of the RTI Act. SIO Sanjay Dhavalikar in an order passed on August 11 while disposing four appeals filed by Shetye had observed that Madeira, the former chief officer and first appellate authority of MMC repeatedly failed to dispose first appeals.The said failure is considered as dereliction of duty and repeated instances of dereliction of duty should not go unpunished, the commission stated. The SIC had directed the present PIO to furnish the requested information to the appellant within 30 days and had asked the chief secretary to seek a written explanation from Madeira for not deciding first appeals in conformity with Section 19(6) of the RTI Act.

PANAJI: In a new twist to the 'land grab' concerning UK home secretary Suella Braverman's ancestral property, her mother Uma Fernandes on Tuesday wrote to the state government requesting it to allow her husband Christie Fernandes and his brother Fr Ayres Fernandes to settle the matter amicably. Her letter comes days after the SIT probing the Goa land scam registered an FIR in the case based on a complaint by Christie himself, who alleged that the ancestral land had been grabbed. In her letter to CM Pramod Sawant, director general of police (DGP) Jaspal Singh and the NRI commissioner, Uma wrote, "I am Uma, the wife of Christo (Christie)... I am a named legal signatory who has given the power of attorney to my brother-in-law Fr Ayres Fernandes through the UK embassy, certified by the Goa deputy collector in 1991. After the completion of the inventory of the properties, the appropriate share (was) given to Fr Ayres Fernandes, Christo Fernandes, Melba Fernandes, and Yolanda Fernandes." Uma said that the sale deed was executed by Ayres with R9 Ventures for property bearing survey no 252/3 dated February 20, 2018, and 253/3 dated January 18, 2019, of Assagao, and the payment was made to Ayres and family by cheque. After three months of the execution of the sale deed, my husband Christo revoked the power of attorney to Ayres following some private internal fraternal dispute. However, I remain the named signatory of the power of attorney to Ayres,” Uma said. The case came to light earlier this month, after the SIT registered the FIR following Christie's claim. In his July 27 letter, he wrote that “an inventory case was filed without my knowledge, and I was represented in the said case by someone who claimed to be my power of attorney”. However, days after the FIR was filed, TOI reported that the land in question was sold by Ayres after Christie gave him the power of attorney. But after the sale deed was executed, Christie revoked the power of attorney through a public notice, and later filed the suit at a local court in Mapusa. Uma, in her letter on Tuesday, said that proceedings in this case have been on since 2019. “We are very happy and have full faith in the Mapusa D-court proceedings, and we want it to continue without any further input from the NRI commission or sensational media coverage from now on,” she wrote. “Thank you for your understanding in this very personal fraternal matter, and allow the two brothers to settle their misunderstanding amicably.”
