Clear Sonsoddo legacy dump by Feb 2023: Court tells govt

Panaji: After finding delays in the clearing of the legacy dump at Sonsoddo, the high court of Bombay at Goa on Wednesday warned the managing director of the Goa Waste Management Corporation (GWMC) and chairperson of the Margao Municipal Council that they will be held personally responsible for non-compliance of its orders.The HC has given the two authorities as well as the contractor, Hindustan Waste Treatment Pvt Ltd, until February 28, 2023, to clear the legacy dump. “This position is made clear in advance because there is a tendency on the part of the authorities to blame the contractor and the contractor to blame the authorities. This has to stop at some stage. It is for the authorities and the contractor to find solutions to their problems. But, under no circumstances to delay the work any further in any case beyond February 28, 2023,” stated Justices Mahesh Sonak and Bharat P Deshpande.Despite granting ample time and opportunities, “both these authorities have, till date, failed to sort out this issue of remediation of the legacy dump”, the HC observed.It also pulled up counsel V Daniel representing the contractor who cited issues about the municipal council not providing them with land or about erratic rains for a long time.Additional government advocate S P Munj submitted a report filed by the managing director of GWMC stating that out of nearly 2.3lakh cubic meter of the legacy waste, the contractor has remediated nearly 1.25 lakh cubic meter.“The managing director of GWMC and the contractor should file status reports by December 20,” the court stated. It said that GWMC should consider invoking the contractor’s performance guarantees if it feels the progress of work is not on schedule as of December 31.
